Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the OnlyMoto mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users, including riders, track owners, shop owners, and photographers.

2. About OnlyMoto

OnlyMoto is a motorsports community platform that connects riders with tracks, shops, events, and photographers. The App is operated by:

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. Users under 18 must have parental or guardian consent.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your profile.

OnlyMoto reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or post harmful content.

5. User Conduct

You agree NOT to:

  • Post false, misleading, or defamatory content about tracks, shops, or other users
  • Harass, threaten, or abuse other members of the community
  • Upload content that is illegal, obscene, or violates third-party rights
  • Attempt to gain unauthorized access to other accounts or system resources
  • Use the App for any commercial purpose not expressly authorized by OnlyMoto
  • Scrape, crawl, or use automated tools to extract data from the App
  • Impersonate any person, track, or organization

6. Track & Shop Owner Responsibilities

Track and shop owners who claim and manage listings on OnlyMoto are solely responsible for the accuracy of their information, including hours, schedules, pricing, rules, and event details.

By connecting a Facebook or Instagram account, you authorize OnlyMoto to read and display your public posts on your listing profile. You may revoke this access at any time.

OnlyMoto is not liable for injuries, accidents, or damages that occur at any listed location. Riders attend and participate at their own risk.

7. Subscriptions & Payments

OnlyMoto offers optional paid subscription tiers for riders, track owners, and shop owners. Subscriptions are billed on a recurring monthly basis through our payment processor, Stripe.

Cancellation: You may cancel your subscription at any time through your account settings. Your access will continue until the end of the current billing period. No partial refunds are issued.

Refunds: All subscription payments are non-refundable except where required by applicable law. If you believe you were charged in error, contact us at onlymotous@gmail.com within 7 days of the charge.

8. User-Generated Content

You retain ownership of content you post (photos, comments, updates). By posting content on OnlyMoto, you grant OnlyMoto a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content within the App and for marketing purposes.

You are solely responsible for content you post. OnlyMoto does not endorse any user-generated content and reserves the right to remove content that violates these Terms or our community standards.

9. Photography & Media

Photographers using OnlyMoto to advertise sessions and share galleries are responsible for obtaining any necessary consent from individuals photographed, in accordance with applicable laws.

OnlyMoto is not responsible for disputes between photographers and riders regarding image rights, usage, or payment.

10. Check-Ins & Location Data

The check-in feature uses your device's GPS to detect proximity to tracks. Location data is used solely to power in-app features and is not sold or shared with third parties.

Check-in information may be visible to other users of the App as part of community features.

11. Third-Party Services

The App integrates with third-party services including Facebook, Instagram, Google Maps, Stripe, and others. Your use of those services is governed by their respective terms and privacy policies.

OnlyMoto is not responsible for the availability, accuracy, or conduct of any third-party service.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ONLYMOTO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

ONLYMOTO MAKES NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY TRACK, EVENT, OR SCHEDULE INFORMATION DISPLAYED IN THE APP.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLYMOTO LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ONLYMOTO'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO ONLYMOTO IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless OnlyMoto LLC and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Meigs County, Tennessee.

16. Changes to These Terms

OnlyMoto reserves the right to modify these Terms at any time. We will notify users of material changes through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

17. Termination

OnlyMoto may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, OnlyMoto, or third parties.
